General Terms and Conditions and Customer Information

I. General Terms and Conditions

§ 1 Basic Provisions

(1) The following terms and conditions apply to contracts that you enter into with us as the provider (Ludwig Artzt GmbH) via the website artztvintage.com/. Unless otherwise agreed, the inclusion of any terms and conditions you may use is hereby rejected.

(2) A “consumer” within the meaning of the following provisions is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity. An “entrepreneur” is any natural or legal person, or a partnership with legal capacity, that acts in the exercise of its independent professional or commercial activity when entering into a legal transaction.

§ 2 Accessibility

(1) Pursuant to § 14(1)(2) in conjunction with Annex 3(1) of the BFSG, we provide information on how our website and our e-commerce services comply with the accessibility requirements of the relevant regulation (BFSGV). This information is accessible via a separate, appropriately labeled button (e.g., “Accessibility Statement” or similar designation) on our website and includes, in particular, the following points:

  • a description of the applicable accessibility requirements;
  • a general description of the service in an accessible format;
  • descriptions and explanations necessary for understanding how the service is provided;
  • a description of how the service meets the relevant accessibility requirements.

(2) The contact information for the competent market surveillance authority is as follows:

State Market Surveillance Agency for the Accessibility of Products and Services – Public-Law Institution (MLBF AöR)
Carl-Miller-Str. 6
39112 Magdeburg
Phone: +49 391 567 6970
Email: kontakt@mlbf-barrierefrei.de

(3) We may use artificial intelligence (AI) and specialized tools to implement accessibility requirements on our website. This is intended to accommodate a wide range of potential disabilities, including visual, auditory, physical, speech, cognitive, and neurological impairments. Further details can be found by clicking the separate, appropriately labeled button on our website mentioned in paragraph 1.

(4) Our website and our e-commerce services are considered accessible if they can be found, accessed, and used by people with disabilities in the usual manner, without undue difficulty, and generally without the need for assistance from others.

(5) Measures to implement the accessibility requirements include, for example, clearly recognizable font sizes and sufficient color contrast, navigability via mouse and keyboard, alternative text for images, captions, and audio descriptions in videos (to the extent that videos are embedded on the website), easy-to-read and understandable language, compatibility with all common screen readers, and customizable display options for various devices (smartphones, tablets, desktop computers, etc.).

§ 3 Formation of the Contract

(1) The subject matter of the contract is the sale of goods, including digital content (data created and provided in digital form).

(2) By listing the respective product on our website, we are making you a binding offer to enter into a contract via the online shopping cart system under the terms specified in the product description.

(3) The contract is formed via the online shopping cart system as follows:
The goods you intend to purchase are placed in the “Shopping Cart.” You can access the “Shopping Cart” via the corresponding button in the navigation bar and make changes there at any time.
After clicking the “Checkout” or “Proceed to Order” button (or similar label) and entering your personal information as well as the payment and shipping details, the order details will be displayed to you as an order summary.

If you use an instant payment system (e.g., PayPal (Express/Plus/Checkout), Amazon Pay, Sofort) as your payment method, you will either be directed to the order summary page in our online store or redirected to the website of the instant payment system provider.
If you are redirected to the respective instant payment system, you will make the appropriate selection or enter your information there. Finally, the order details will be displayed as an order summary on the website of the instant payment system provider or after you have been redirected back to our online store.

Before submitting the order, you have the option to review the information in the order summary once more, make changes (including by using your web browser’s “Back” button), or cancel the order.

By submitting the order via the corresponding button (“Place Order with Payment,” “Buy” / “Buy Now,” “Order with Payment,” “Pay” / “Pay Now,” or a similar designation), you legally and bindingly accept the offer, thereby concluding the contract.

(4) Your requests for a quote are non-binding. We will submit a binding offer to you in writing (e.g., via email), which you may accept within 5 days (unless a different deadline is specified in the respective offer).

(5) The processing of the order and the transmission of all information required in connection with the conclusion of the contract are carried out via email, in part automatically. You must therefore ensure that the email address you have provided to us is correct, that receipt of the emails is technically ensured, and, in particular, that it is not blocked by spam filters.

§ 4 License to Use Digital Content

(1) The digital content offered is protected by copyright. For each piece of digital content purchased from us, you will receive a license from the respective licensor. The nature and scope of the license are set forth in the license terms specified in the respective offer.

§ 5 Formation of the Contract for Courses

(1) The subject matter of the contract is the conduct of courses.

Our offers on the Internet are non-binding and do not constitute a binding offer to enter into a contract.

(2) You may submit a binding offer (order) via the online shopping cart system.
The courses you intend to book are placed in the “shopping cart.” You can access the “shopping cart” via the corresponding button in the navigation bar and make changes there at any time. After clicking the “Checkout” or “Proceed to Order” button (or similar label) and entering your personal information and payment details, you will be shown a summary of your order details.
Before submitting the order, you have the option to review all details here, make changes (including by using your web browser’s “Back” function), or cancel the order.
By submitting the order via the corresponding button, you are making a binding offer to us.
You will first receive an automatic email confirming receipt of your order; this does not yet constitute the conclusion of a contract.

(3) Acceptance of the offer (and thus the conclusion of the contract) occurs within 2 days via written confirmation (e.g., by email), in which your booking is confirmed (booking confirmation). If you have not received such a message, you are no longer bound by your booking. Any services already provided will be refunded immediately in this case.

(4) The processing of the order and the transmission of all information required in connection with the conclusion of the contract are carried out via email, in part automatically. You must therefore ensure that the email address you have provided to us is accurate, that receipt of the emails is technically guaranteed, and, in particular, that it is not blocked by spam filters.

§ 6 Provision of Services for Courses

(1) Courses will be conducted in the manner described in the respective course descriptions on the agreed-upon dates.

(2) To the extent that the conduct of the courses depends on the number of participants, the minimum number of participants is specified in the respective course description.
If the minimum number of participants is not reached, we will notify you in writing (e.g., by email) no later than 7 days before the course begins that the booked course will not take place. In this case, any fees already paid will be refunded immediately.

(3) If an individual session is canceled due to the instructor’s last-minute absence because of illness or for another important reason, any fees already paid will be refunded immediately.
For programs consisting of multiple sessions, if a session is canceled due to the instructor’s last-minute absence because of illness or for another important reason, the canceled session will be rescheduled for an alternative date.

(4) In connection with the use of course rooms and facilities, you must comply with the house rules posted on-site. You must follow our instructions or those of the course instructor.

§ 7 Substitute Participants

You may designate a substitute participant at any time before the course begins. There is no charge for this change of registration.

§ 8 Contract Term / Termination of Subscription Contracts

(1) The subscription contract concluded between you and us is of indefinite duration. The contract may be terminated by either party with one month’s notice to the end of the month (unless otherwise specified in the respective offer).

(2) The right to terminate the contract without notice for good cause remains unaffected by this provision.

(3) Any notice of termination must be given and transmitted either in writing (e.g., via email) or via the termination button provided on our website (“Cancel Contracts Here” or a similar designation).

§ 10 Provision of Services for Gift Certificates (Gift Certificate Terms)

(1) Unless otherwise specified in the offer or on the gift certificate, we are the issuer of the gift certificate. Our name and address are listed in our contact information in the legal notice.

(2) Purchased gift certificates entitle you to redeem the credit amount specified on the gift certificate with us within the validity period (validity term). Gift certificates may be redeemed exclusively in our online store at artzt.eu/ or, if specified, at our physical retail location. The service description and the redemption terms outlined therein at the time of purchase apply.

(3) The validity period of the gift certificate is 3 years from the date of purchase, ending at the close of the calendar year, unless a different validity period is specified in the respective offer.

(4) Full payment of the purchase price for the gift certificate is a prerequisite for redeeming it. The gift certificate must be redeemed during the electronic ordering process on our website by entering the gift certificate code into the designated field. Subsequent offsetting is not permitted. Any remaining balance remains on the gift certificate and can be used for future orders.

(5) Only one gift certificate may be redeemed per order.

(6) No refunds or exchanges will be made after the cancellation period has expired or the consumer’s right of cancellation has lapsed. A full or partial cash payout of gift certificate balances is not possible. No interest is paid on the gift card balance. If the statutory right of withdrawal is exercised for goods or services paid for with the gift card, the gift card amount included in the purchase price will be credited exclusively as a gift card. Unless otherwise specified, the validity period of the credited gift card corresponds to the validity period of the gift card used for the order.

(7) The voucher may be transferred or assigned.

§ 11 Right of Retention, Retention of Title

(1) You may exercise a right of retention only to the extent that it relates to claims arising from the same contractual relationship.

(2) The goods remain our property until the purchase price has been paid in full.

(3) If you are a business, the following applies in addition:

a) We reserve title to the goods until all claims arising from the ongoing business relationship have been settled in full. Pledging or transfer of ownership by way of security is not permitted prior to the transfer of title to the goods subject to retention of title.

b) You may resell the goods in the ordinary course of business. In such a case, you hereby assign to us all claims in the amount of the invoice total arising from the resale; we accept such assignment. You remain authorized to collect the claim. However, if you fail to properly fulfill your payment obligations, we reserve the right to collect the claim ourselves.

c) In the event of combination or mixing of the goods subject to retention of title, we shall acquire co-ownership of the new item in the ratio of the invoice value of the goods subject to retention of title to the other processed items at the time of processing.

d) We undertake to release the security to which we are entitled at your request to the extent that the realizable value of our security exceeds the claim to be secured by more than 10%. The selection of the security to be released is at our discretion.

§ 12 Warranty

(1) The statutory rights regarding liability for defects apply.

(2) To the extent that you are informed of this by us prior to our submission of the contractual declaration and this has been expressly and separately agreed upon, the statute of limitations for claims for defects in used goods is one year from delivery of the goods. The foregoing limitation does not apply:

- to damages attributable to us resulting from injury to life, limb, or health caused by fault, or to other damages caused intentionally or through gross negligence;

- to the extent that we have fraudulently concealed the defect or have assumed a guarantee for the quality of the goods.

(3) As a consumer, you are requested to inspect the goods immediately upon delivery for completeness, obvious defects, and shipping damage, and to notify us and the carrier of any complaints as soon as possible. Failure to do so shall have no effect on your statutory warranty claims.

(4) To the extent that a characteristic of the goods deviates from objective requirements, such deviation shall be deemed agreed upon only if we informed you of it prior to your submission of the contractual declaration and the deviation was expressly and separately agreed upon between the contracting parties.

(5) If you are a business, the following shall apply in deviation from the above warranty provisions:

a) Only our own specifications and the manufacturer’s product description shall be deemed agreed upon as the quality of the goods; however, other advertising, public promotions, and statements by the manufacturer shall not be considered as agreed upon.

b) In the event of defects, we shall, at our discretion, provide warranty by repair or replacement. If the remedy fails, you may, at your discretion, demand a price reduction or withdraw from the contract. The attempt to remedy the defect shall be deemed to have failed after a second unsuccessful attempt, unless the nature of the goods, the defect, or other circumstances indicate otherwise. In the event of repair, we are not required to bear the increased costs incurred by transporting the goods to a location other than the place of performance, provided that such transport does not correspond to the intended use of the goods.

c) The warranty period is one year from the delivery of the goods. The shortened warranty period does not apply:

- to damages attributable to us resulting from injury to life, limb, or health, or to other damages caused intentionally or through gross negligence;
- to the extent that we have fraudulently concealed the defect or have provided a guarantee regarding the quality of the item;
- for goods that have been used in a structure in accordance with their customary use and have caused the structure’s defectiveness;
- for statutory recourse claims that you have against us in connection with rights arising from defects.

§ 13 Governing Law, Place of Performance, Jurisdiction

(1) German law applies. For consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country of the consumer’s habitual residence (principle of favorability).

(2) The place of performance for all obligations arising from business relationships with us, as well as the venue, is our registered office, provided that you are not a consumer but rather a merchant, a legal entity under public law, or a special fund under public law. The same applies if you do not have a general venue in Germany or the EU, or if your domicile or habitual residence is unknown at the time the action is filed. The right to bring an action before a court at another statutory place of jurisdiction remains unaffected by this provision.

(3) The provisions of the UN Convention on Contracts for the International Sale of Goods are expressly excluded.
